Troy DUI Attorneys
The severity of injuries and the high number of fatalities that result from drunk driving accidents have heightened awareness of the problem nationwide. Michigan is no different. If you have been charged with driving under the influence (DUI) of alcohol or drugs, you face stiff penalties, including suspension of your driver’s license.
At Sakis & Sakis, PLC, our experienced criminal defense lawyers meet the aggressive prosecution of drunk driving charges with aggressiveness of their own. First, we review every aspect of your arrest to ensure that your constitutional rights were not violated. An illegal stop may be cause to have the charges dismissed.
We also closely review the arresting officer’s method of assessing your condition, the administration of a roadside sobriety test, and the administration of a breath or blood test to determine your blood alcohol concentration (BAC). Depending upon the circumstances involved, we may be able to challenge the timing or the accuracy of the BAC test that was administered.
A Thorough Understanding Of Michigan OWI Laws
Michigan law states that anyone who operates a motor vehicle with a BAC of .08 or above is operating while intoxicated (OWI). If you are stopped by authorities for operating a motor vehicle erratically and found to have a BAC below .08, you may still be cited for operating while visibly impaired (OWVI).
A first-time conviction of OWI is most often a misdemeanor punishable by a fine up to $500 and suspension of your driver’s license up to 30 days, followed by driving restrictions for another 150 days. Additional and substantial costs include a $1,000 driver responsibility fee. A second conviction could be punishable by a fine up to $1,000, as much as one year in jail and revocation of your driver’s license for a minimum of one year.
